The Reason for the Field Sobriety Test in the State of Oregon
Interviewer: When they pull you out of the car, what are they going to make you do? What are the field sobriety tests that they’ll have you do? What is standard?
Shannon: They’re going to ask you to take the field sobriety test. It is not necessary to have you do the field sobriety test to arrest you for DUII. A lot of people are under the impression that, “I passed the field sobriety test. I’m scot-free. I get to go.” That’s not necessarily the case.
It’s an officer tool to look for additional clues for DUII. They’re continuing to observe you after they ask you to step out of the vehicle. They’re continuing to observe your fine motor skills. Do you have any difficulty exiting the vehicle? Are you repeating questions back to them?
Emotions that you might exhibit that they look for include anger, aggressiveness and defensiveness Do you sway? Are you on your feet? Do you have balance problems? Do you need to lean on the door of the vehicle as you get out of the vehicle? Is the odor of alcohol stronger now that you’ve stepped out of the car?
